OUR MISSION:

SUE is committed to exploring and promoting community engagement, while challenging and improving the current concept of urban lifestyle in the midwest. Modern, chic, trendy, and accessible are words that embody the concept of the urban lifestyle. SUE seeks to educate and inform the young professional consumer interested in a diverse Midwest, its upscale retail, cultural amenities, quality entertainment, its support systems and its associated issues.

Springfield’s Urban Edge Website Terms of Use Agreement

Springfield’s Urban Edge provides the following site to you, subject to these Terms of Use, which may be updated or modified periodically without notice. PLEASE READ THESE TERMS AND CONDITIONS OF USE CAREFULLY BEFORE USING THIS SITE.

By using this site and the sites provided herein, you signify your agreement to these Terms of Use. If you do not agree to these Terms of Use, please do not use the Springfield’s Urban Edge site. Failure to comply with these Terms of Use may result in the deletion of your account and the removal of your content from any an all of the website.

Submission Content

All content posted to Springfield’s Urban Edge in any form, is the responsibility and property of the author. Springfield’s Urban Edge is committed to keeping the site in decent standing for all audiences, but is not responsible for the monitoring or filtering in using its site. Those users posting material not suitable for all audiences must agree that they are fully responsible for all the content they have posted anywhere on the site. Should the content be deemed illegal by such law having jurisdiction over the site, Springfield’s Urban Edge is committed to submitting all necessary information to the proper authorities.

Should any content posted to Springfield’s Urban Edge be reported to Springfield’s Urban Edge as being offensive or inappropriate, Springfield’s Urban Edge has the full authority to remove from its site, any infringing content. Springfield’s Urban Edge is under no obligation to restrict or monitor the content posted to its site by Users or the contents of the comments and forums listed in any way, nor is it responsible in any way for the contents of the blogs and forums listed by its site.

Springfield’s Urban Edge claims no ownership or control over any content posted by Users to its site. The User retains all patent, trademark, and copyright to all content posted within available fields, and is responsible for protecting those rights, but is not entitled to the help of the Springfield’s Urban Edge staff in protecting such content.

User Conduct

You agree to NOT use this site to:

Upload, post, link to or otherwise transmit any content that is in Springfield’s Urban Edge opinion to be unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive to another's privacy (including, but not limited to any address, email, phone number, or any other contact information without the explicit consent of the owner of such information), hateful or racially, ethnically or otherwise objectionable.

Impersonate any person or entity, including, but not limited to any Springfield’s Urban Edge agent or volunteer, or falsely state or otherwise misrepresent your affiliation with any person or entity.

Use the site to transmit chain letters, junk mail, spamming or any use of distribution to any person who has not given specific permission to be included in such a process.

Forge or manipulate identifies in order to disguise the origin of any content transmitted through the site.

Upload, post, link to or otherwise transmit any content that you do not have a right to transmit under any law or contractual relationship, including, but not limited to, content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party.

Upload, post link to, or otherwise transmit any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit he functionality of any computer software or hardware or telecommunications equipment.

Interfere with or disrupt the site or servers or networks connected to the site or disobey any requirements procedures, policies or regulations of networks connected to the site.

Intentionally or unintentionally violate any applicable internet governing laws or regulations, local, state, national or international law or regulations.

Stalk or otherwise harass another person.

Collect or store personal data about other Users for business purposes.

Promote or provide instructional information about illegal activities.

Disclaimer of Warranties

You expressly understand and agree that your use of the site is at your sole risk. The site is provided on an "as is" and "as available" basis. Springfield’s Urban Edge expressly disclaims all warranties of any kind, whether express or implied including, but not limited to the information's fitness for a particular purpose and non-infringement. Springfield’s Urban Edge makes no warranty that the site will meet your requirements or expectations, that the site will be uninterrupted, timely, secure, error free or that any software errors will be corrected. Any material downloaded or otherwise obtained through the use of the site is done at your own discretion and risk and that you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material.

Limitation of Liability

You expressly understand and agree that Springfield’s Urban Edge shall not be liable for any direct, indirect, incidental, special consequential or exemplary damages, including but not limited to damages for use, data or other intangible losses resulting from:

You acknowledge and agree that Springfield’s Urban Edge is not responsible for the availability and does not endorse, nor is responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources.

Blogger Account, Password and Security

You are entirely responsible if you do not maintain the confidentiality of your password and account. You are entirely responsible for any and all activities which occur under your account. You may change your password at any time and you may also set up a new account and close an old account at your convenience.

Indemnity

You agree to hold Springfield’s Urban Edge and its agents harmless from any claim or demand, including all attorney fees, made by any third party due to or arising out of your content, your use of the site, your connection to the site, your violation of the Terms of Use, or your violation of any rights of another, whether you have submitted content to the site or not. The User is solely responsible for his or her actions when using the site, including, but not limited to, costs incurred for internet access.

Proprietary Rights to Content

User acknowledges that content, including but not limited to text, software, music, sound, photographs, video, graphics or other material contained in either sponsor advertisements or email-distributed, commercially produced information presented to User by the site (Springfield’s Urban Edge) or Springfield’s Urban Edge Advertisers, is protected by copyrights, trademarks, site trademarks, patents or other proprietary rights and laws; therefore, user is only permitted to use this content as expressly authorized by Springfield’s Urban Edge or Advertisers. User may not copy, reproduce, distribute, or create derivative works from this content without expressly being authorized to do so by Springfield’s Urban Edge or the Advertiser.

Notices

All notices to a party or general users shall be in writing and shall be made either via email, conventional mail, or posting on the Springfield’s Urban Edge website. Any such communication will constitute notice.

Termination or Blocking

You agree the Springfield’s Urban Edge, in its sole discretion, may remove your content from the site, for any reason, including and without limitation, or if Springfield’s Urban Edge believes that you have violated or acted inconsistently with the letter or spirit of the Terms of Use. Springfield’s Urban Edge may also in its sole discretion and at any time, discontinue providing the site, or any part thereof, with or without notice. You agree that any termination of your access to the site under any provision of this Terms of Use may be effected without prior notice and acknowledge and agree that Springfield’s Urban Edge may immediately delete your content from its database. Springfield’s Urban Edge reserves the right to bar any further access to such content or the site. You agree that Springfield’s Urban Edge shall not be liable to you or any third-party for any termination of your access to the site.

Privacy Policy

It is Springfield’s Urban Edge policy to respect the privacy of users. Therefore, Springfield’s Urban Edge will not disclose to any third party User's name or contact information. Springfield’s Urban Edge will also not monitor, edit or disclose the contents of a Member's information unless required to do so by law or in the good faith belief that such action is necessary to conform to the edicts of the law or comply with legal process served on Springfield’s Urban Edge, protect and defend the rights or property of Springfield’s Urban Edge, act under exigent circumstances to protect the personal safety of Springfield’s Urban Edge users and/or the public.

The nature of blogging is to reach a public audience. Please be aware that any information that you submit, whether through forms or email, including personally identifiable information, may be publicly displayed on the website hosted by Springfield’s Urban Edge or on websites not within our control. If you don't want others to see such information, please don't submit it.

To report violations of this Terms of Use, please email the Executive Director. Any complaints of violation must be in writing and if email is not available, please send written complaint to Dyi Kinney, Executive Director of Springfield’s Urban Edge, PO Box 602, Springfield, IL 62705.

General Information

The Terms of Use Agreement constitutes the entire agreement between you and Springfield’s Urban Edge and governs your use of the site, superseding any prior agreements between you and Springfield’s Urban Edge (including, but not limited to, any prior version of the Terms of Use). The laws that govern the State of Minnesota, USA, shall govern the Terms of Use and the relationship between you and Springfield’s Urban Edge. You agree that regardless of any statute, law, or regulation to the contrary, any claim or cause of action arising out of or related to use of the site or the Terms of Use must be filed within one (1) year after such claim or cause of action arose or be forever barred. The section titles in the Terms of Use are for convenience only and have no legal or contractual effect.
